SmartPool makes every attempt to remove all unauthorized uses of its intellectual property from eBay through its participation in the eBay VeRO Program. SmartPool reviews auction listings to determine whether its Intellectual Property is being misused, such as improper use of trademarks or copyrights and products being sold below MAP pricing. Due t... o the number of listings for SmartPool products on eBay, SmartPool is not always able to identify and remove every unauthorized listing. Sellers on eBay must be responsible for their own conduct and must ensure that they are not violating SmartPool's intellectual property rights. To this end, it is a Policy violation to use copyrighted photographs of SmartPool products to promote the sale of the item you are listing, even if you "found" those images on the Internet, unless SmartPool permission has been received. (Publication on the Internet by the copyright owner does not release the images into the public domain for use by all without liability). Anyone who produces, copies, distributes or displays SmartPool's copyrighted materials, including photographic images and accompanying item descriptions appearing on the SmartPool website and/or advertisements without SmartPool's permission may be liable for copyright infringement.
