The framework of this approach places too much weight on the "rogue state" designation, which criminalizes enemy states and, accordingly, denies them standard protections of international law. Allowing every state to justify aggression in this manner is a clear recipe for anarchy. It would substitute name-calling and unilateral aggression for the rule of international law. Within any legitimate legal order, there are no criminal persons or states, but only criminal acts. There is no such thing as a rogue nation. There are only roguish acts, such as the promotion of terrorist activities and the unprovoked and harmful invasion of another state.
