Bentley Receivership

Important Update: The Receivers recent efforts have been directed toward the resolution of two open litigation matters, one pending in the US District Court for the Eastern District of PA (w... hich was dismissed, but reinstated on appeal); and a second which is waiting to be scheduled for trial in the Court of Common Pleas for Montgomery County, Pennsylvania. Once the litigation is concluded, the Receiver expects to terminate the Receivership by resolving any remaining tax and other business matters of the Bentley entities and the Receivership. The Receiver can make no prediction as to when these matters will be finalized; nor can the Receiver predict when, whether or to what extent there will be a final distribution when the Receivership is ultimately closed. The federal court matter has been settled after multiple appearances before the supervising judge and a magistrate judge acting as mediator. The settlement proceeds of $1,175,000 (our claim, which was hotly contested by Hartford Insurance Company, was for 1.9m) as approved by the Court have been deposited in the Receivership account. In the Montgomery County Court case, the defendant, (Bryn Mawr Trust Co.) has persuaded the Court to reopen discovery as to issues we think are irrelevant, but this will further delay the setting of a trial date in this already much delayed case.
