October 27, 2017 Michelle Litteken was recently quoted by Bloomberg Government Federal Contracts Report in their recent article "Raytheon's Win in Conflicts Case Serves as a Vetting Reminder. When asked about screening federal contract employees and preventing conflicts of interest, Ms. Litteken responded, "Contractors should gain an understanding of the new employee's prior level of authority and obtain the employee's former job description,'' she said. ''Contractors should also obtain a copy of the employee's ethics opinion if one was prepared by the former employee. ''New employees may need to be firewalled from activities for which they have competitively useful nonpublic information,'' she added. In some situations, ''a contractor may want to have the new employee sign representations and certifications regarding the information provided,'' she said. ''Additionally, it cannot be forgotten that former federal employees are often subject to post-employment restrictions that limit what the employee can do in the private sector.'' Associate Michelle Litteken represents clients in bid protests at the Government Accountability Office and the Court of Federal Claims and in size and status protests at the Small Business Administration and the Office of Hearings and Appeals. She assists clients in preparing claims, requests for equitable adjustment, termination settlement proposals and prosecutes contractor claims under the Contract Disputes Act at the Court and at the Boards of Contract Appeals. Ms. Litteken advises clients on teaming agreements and subcontracts related to public contracts. She also counsels clients on matters involving security clearances and regulatory compliance, including potential organizational conflicts of interest and SBA's HUBZone, Woman-Owned, Service-Disabled Veteran Owned, and 8(a) programs. Prior Experience Prior to joining PilieroMazza, Ms. Litteken was a Litigation & Dispute Resolution associate in Mayer Brown LLP's Washington DC office. Her practice focused on government contracts matters. She represented clients regarding federal procurement practices and activities, such as litigating large contract disputes and bid protests before the United States Court of Federal Claims and the Government Accountability Office. Before joining Mayer Brown in 2013, Ms. Litteken clerked for Judge Mary Ellen Coster Williams at the United States Court of Federal Claims from 2012-2013. Before her clerkship, Ms. Litteken was an associate in Paul Hasting LLP's Washington DC office, where her practice focused on antitrust and commercial litigation. Ms. Litteken is the Vice Chair of two American Bar Association Public Contracts Law Section Committees: Bid Protests, and Contracts Claims and Dispute Resolution Member of the board of the Court of Federal Claims Bar Association Newly Admitted Attorneys Division Super Lawyers has recognized Ms. Litteken as a top government contracts lawyer under 40 by naming her to the 2017 list for Rising Stars in Government Contracts Law.
