EAC and Brian Newby Sued for Adding Proof of Citizenship Requirement - Lawyers Democracy Fund

A lawsuit has been filed against the Election Assistance Commission and its Executive Director Brian Newby by a coalition of voting groups.
The suit alleges that Newby impermissibly changed the instructions on the federal voter registration form to require proof of citizenship to complete a registration in Arizona, Georgia, and Kansas, in accordance with state laws. View the complaint here.

Brian Newby
Brian D. Newby is currently the Executive Director of the United States Election Assistance Commission. Brian was first appointed Johnson County Election Commissioner by Kansas Secretary of State Ron Thornburgh in January 2005 and has served under Secretary of State Chris Biggs and the current Secretary, Kris Kobach. Newby has administered more elections than any of his predecessors and is the only Election Commissioner in state history to have been appointed by both Republican and Democratic Secretaries of State. During his tenure, the office has received national recognition for operational and technological innovation excellence.

Voting Rights Groups Ask Federal Court to Move Forward in Case Over Burdensome Voter Registration Requirements | Brennan Center for Justice

Newby, a case challenging a federal official's decision to change federal voter registration forms to require documentary proof of citizenship in Kansas, Alabama, and Georgia. (That change is currently blocked by an earlier decision in this lawsuit.)
In the case, plaintiffs argue that Brian Newby, the executive director of the U.S. Election Assistance Commission, was not authorized to make this change on behalf of the Commission, which Congress stipulated can only act with bipartisan agreement of three of the agency's commissioners. In the briefs, plaintiffs point out that the agency was split along partisan lines over whether Newby acted within his purview, and acknowledged that they failed to reach a decision in a memo filed in federal court earlier this summer.
