    Joel Riff is Co-Chair of Hoge, Fenton's Intellectual Property Group.     It seems straight forward, but Joel Riff, an attorney with GCA Law Partners in Mountain View is concerned that the language is so vague that e-mail sent with noncommercial intentions could be interpreted the wrong way.

    "The definition is potentially broad enough that you can make an argument basically that virtually anything sent in a business context is commercial e-mail," Riff says.

    If it is determined that the primary purpose of the e-mail is to promote a commercial product or service, complying with the law means that the sender of the e-mail must include a physical address, a valid return e-mail address, and a feature that allows recipients to unsubscribe from the e-mail.The unclear issue here is how "primary purpose" is defined, Riff says.
