    INTERGOVERNMENTAL AGREEMENT WITH CITY OF RINGGOLD - RAIL VIEWING PLATFORM County Attorney Chad Young presented the Board with the proposed intergovernmental with the City of Ringgold for a rail-viewing platform.The City of Ringgold is requesting that the County enter the agreement by which the County will donate the land for the rail-viewing platform and the City will construct the platform at their expense.Mr. Young stated the agreement does also contain a termination clause which in the case of the County deciding the property is needed the County may terminate the agreement and would be required to reimburse the City of Ringgold for the money spent to construct the platform.Mr. Young stated the agreement is for 50years.

    ZONING ORDINANCE AMENDMENT - YARD SALES AND SWIMMING POOLS County Attorney Chad Young presented the proposed zoning ordinance amendment pertaining to yard sales and swimming pools.Mr. Young said the amendment simply relocates the regulation about swimming pools, the current regulation states that if you are within a number of feet of another residence you must have your pool fenced and specifies the requirements.Mr. Young said that section was put on the end of the sign ordinance and did not belong so he has cleaned that up and moved it.Mr. Young stated the second part of the amendment pertains to the regulation of yard sales and the Planning Commission was concerned with the perpetual yard sales that are ongoing.Mr. Young said the proposed regulation will allow yard sales once a quarter and may continue for a 72-hour period.Mr. Young said it would prohibit flea markets.

    RECOMMENDATION FROM PUBLIC WORKS/SOLID WASTE MANAGEMENT AUTHORITY FOR THE APPROVAL OF PROPOSAL SUBMITTED BY THE CITY OF RINGGOLD FOR THE 2004 SPLOST CYCLE PEAVINE BASIN SEWER PROJECTS County Attorney Chad Young stated that at the last meeting of the Public Works/Solid Waste Management Authority the City of Ringgold presented a proposal for the City of Ringgold to act as the Projects Administrator for the County for sewer projects in the Peavine Basin that are constructed with SPLOST funds.The City would propose they would work with the County, the County would still bid the project, still select the engineer, still select the contractor and enter into the contracts.The City would have input and would help to acquire easements and work with the contractor on technical issues about the sewer lines.The City feels this would help projects run more smoothly and will help expedite projects.Mr. Young stated the Public Works Authority voted unanimously to recommend approval of the proposal to the Board of Commissioners.Mr. Young stated if the Board approves the proposal he will draft an intergovernmental agreement between the County and the City and work the terms out and present it to the Board.
