  INTERGOVERNMENTAL AGREEMENT WITH CITY OF RINGGOLD - RAIL VIEWING PLATFORM County Attorney Chad Young presented the Board with the proposed intergovernmental with the City of Ringgold for a rail-viewing platform.The City of Ringgold is requesting that the County enter the agreement by which the County will donate the land for the rail-viewing platform and the City will construct the platform at their expense.Mr. Young stated the agreement does also contain a termination clause which in the case of the County deciding the property is needed the County may terminate the agreement and would be required to reimburse the City of Ringgold for the money spent to construct the platform.Mr. Young stated the agreement is for 50years.

  QPUBLIC CONTRACT FOR HOSTING GIS DATA County Attorney Chad Young presented the contract between the County and Qpublic for the purpose of hosting GIS data on the web.Attorney Young stated the additional cost for hosting the GIS data on the site would be $3000 annually.

  RINDT-MCDUFF CONTRACT FOR GROVES/TOWNSEND ESTATES SEWER PROJECT County Attorney Chad Young stated the Board of Commissioners previously approved the proposal from Rindt-McDuff Associates for the engineering for the Groves/Townsend Estates sewer project.Attorney Young stated the form contract submitted by Rindt-McDuff had a few provisions he requested they change, which has now been completed and he is recommending the Board of Commissioners approve the contract.

  WEST CHICKAMAUGA BASIN SEWER PROJECT CHANGE ORDER - ARCADIS County Attorney Chad Young presented the change order request from Arcadis for the West Chickamauga Basin Sewer Project.Mr. Young stated the change order is for the pump station portion of the project and is due to a stretch of 100ft. that must be underground for power to get to the pump station.Mr. Young stated the Public Works Authority approved the change order not to exceed $9000 and recommends approval by the Board of Commissioners.

  County Attorney Chad Young stated the authorization given to his office to file a lawsuit was given at the last meeting, before that there was some negotiations about a 3rd party neutral giving an opinion and those did not work out.Attorney Young stated there were issues about annexation going back almost a year ago regarding the Patel property and at one point the property was not annexed by the City, it was voted down.Attorney Young stated Attorney Skipp Patty is handling the lawsuit and has written a demand letter on November 6, to the City Attorney/City Manager Ron Goulart that the property be deannexed.

  RESOLUTION FOR APPOINTMENT OF DEPARTMENT HEADS County Attorney Chad Young stated the current status of the County's Ordinances require that the County Manager get the approval to hire Department Heads with his recommendation pursuant to the Board's instruction he will be preparing an amendment pertaining to that for the Board to consider later.Mr. Young stated the Board of Commissioners need to consider ratifying the County Managers hiring of Ann Cain as Department Head of Human Resources, and the promotion of Donald Brown to the position of Department Head of Zoning/Stormwater/Building Inspection/Codes Enforcement.

  ZONING ORDINANCE AMENDMENT - YARD SALES AND SWIMMING POOLS County Attorney Chad Young presented the proposed zoning ordinance amendment pertaining to yard sales and swimming pools.Mr. Young said the amendment simply relocates the regulation about swimming pools, the current regulation states that if you are within a number of feet of another residence you must have your pool fenced and specifies the requirements.Mr. Young said that section was put on the end of the sign ordinance and did not belong so he has cleaned that up and moved it.Mr. Young stated the second part of the amendment pertains to the regulation of yard sales and the Planning Commission was concerned with the perpetual yard sales that are ongoing.Mr. Young said the proposed regulation will allow yard sales once a quarter and may continue for a 72-hour period.Mr. Young said it would prohibit flea markets.

  ZONING ORDINANCE AMENDMENT - CELL TOWERS County Attorney Chad Young presented the proposed zoning ordinance amendment pertaining to cell towers and similar structures.Mr. Young stated the Planning Commission would like that cell towers are one of those uses that are required to get a special use permit.Mr. Young said that would require it to meet all the requirements of cell towers and special use permits and would have to come before the Board of Commissioners for approval.

  ZONING ORDINANCE AMENDMENT - A-1 DISTRICT County Attorney Chad Young presented the proposed zoning ordinance amendment pertaining to the regulations of an A-1 agricultural zoning district.Mr. Young stated the main change in the amendment, currently the lot size in an A-1 district is 1 acre, and the planning commission has recommended that the lot size be raised to 3 acres.

  RECOMMENDATION FROM PUBLIC WORKS/SOLID WASTE MANAGEMENT AUTHORITY FOR THE APPROVAL OF PROPOSAL SUBMITTED BY THE CITY OF RINGGOLD FOR THE 2004 SPLOST CYCLE PEAVINE BASIN SEWER PROJECTS County Attorney Chad Young stated that at the last meeting of the Public Works/Solid Waste Management Authority the City of Ringgold presented a proposal for the City of Ringgold to act as the Projects Administrator for the County for sewer projects in the Peavine Basin that are constructed with SPLOST funds.The City would propose they would work with the County, the County would still bid the project, still select the engineer, still select the contractor and enter into the contracts.The City would have input and would help to acquire easements and work with the contractor on technical issues about the sewer lines.The City feels this would help projects run more smoothly and will help expedite projects.Mr. Young stated the Public Works Authority voted unanimously to recommend approval of the proposal to the Board of Commissioners.Mr. Young stated if the Board approves the proposal he will draft an intergovernmental agreement between the County and the City and work the terms out and present it to the Board.

  County Attorney Chad Young stated the purpose of the Public Hearing is to invite public comment on a proposed Resolution to be considered by the Board of Commissioners to enact E911 Phase II, the essential Resolution before the Board today is to authorize the increase of the current charge of $1.00 per cell phone customer per month to $1.50 per month.Mr. Young stated the increase in charge is authorized by statute for the purpose of allowing the County to install technology that will allow 911 operators to pinpoint the location of a cell phone call.

  Attorney Chad Young presented the proposed Floodplain Management and Flood Damage Prevention Ordinance.Mr. Young stated that this Ordinance and the remaining Ordinances that would be considered during the public hearings are based on the model ordinances provided to the County by EPD at the state level.Attorney Young stated that EPD has requested that the County adopt the ordinances so that the County can qualify for the NPDES Stormwater Permit.Attorney Young stated the first ordinance is not that different from the ordinance the County already has.
