    Council member Ron Wolaver said that , in mid-August , Mayor Don Maxwell was served with an official-looking document which threatened to sue him and threatened him with the loss of money and property.It's intimidation , plain and simple , Wolaver said of the document.Don Maxwell is a civic-minded Marysville resident , who has volunteered his services at a time when the borough really needed him.He doesn't deserve this kind of treatment and we're not going to put up with it..The document alleges abuse of process , citing the mayor for wrongful doings for personal gain ... wrongful doings to Marysville residents and employees..The other charge listed accuses the mayor of unlawful assembly for signing a borough resolution on June 8 when the mayor's oath of office was signed , sworn and subscribed on June 10 , 1998..The document lists no docket number nor does it indicate that it was actually filed in court.It does , however , warn Maxwell to take prompt action.

    Marysville council seeks to reclaim attorney fees - [Cached Version]

    It's a lot of money for a small town , said council member Ronald Wolaver.The citizens of Marysville ought not to have to pay fees to defend what we believe was a frivolous lawsuit..Wolaver added that council believed that the suit was brought in bad faith and , as a result , is able to seek the return of the attorney's fees under a clause in the Sunshine Act that protects the council from such suits.MAC members have 10 days to respond to the motion and their attorney , Corky Goldstein , says they will meet the deadline with the expectation of turning in a response by Thursday.Goldstein said that he took up the case when the members of MAC were served with court papers on Friday.Concerned about the money involved , they called Goldstein , who agreed to take their case on a pro bono basis and has not committed to helping the group in the future.Goldstein believes that the ability of citizens to use the court to address wrongs is a basic right and that borough council's decision to seek attorney's fees is simply intimidation and a warning to citizens to not file such actions in the future.I find it to be totally offensive , he said.Goldstein noted that the case was not dismissed on its merits , but on a technicality - that the plaintiffs did not file the suit within a required 30-day time frame.It doesn't mean that the citizens don't have a case , he added.Bad faith , he explained , means that there was a sinister motive behind MAC's decision to file a suit ; that they knew they had no grounds.They ( borough council ) would have to show that these people committed a fraud , Goldstein said.Goldstein plans to request a hearing on the matter and is confident that borough council's request will be denied.

    RONALD L. WOLAVERRonald L. Wolaver, 64, of Duncannon died Thursday, Feb. 12, 2004 in Holy Spirit Hospital, Camp Hill.

    He was the son of the late Joseph A. Sr. and Sarah M. Wolaver.

    He was co-owner of the Marysville Tavern; a Marysville Borough Council member for 16 years, where he served as a special project manager of the sewer plan; an Army veteran; a member of Marysville VFW Post 882 and Mechanicsburg American Legion Post 0109; co-founder and member of Overview Anglers Club; and a member and past president of Marysville Sportsmen's Association for 15 years.
