Mr. Witten graduated with Honors from Auburn University in 1968 and completed University of Kansas School of Law in 1971.
He was admitted to practice in 1971.
He is a member of the Kansas City Metropolitan and Kansas Associations.
He is a member of the American Bar Association where he served as Vice Chair for ABA-TIPS, Fidelity and Surety Law Committee from 1997-2001.
He currently serves as Vice President of the Surety Claims Institute.
He was a member of the Board of Editors for the Kansas Law Review from 1969-1971.
He is the author of "Recovery of Damages for Delay Against Sureties on Public Work Bonds," 20 The Forum 640 (1985); "Barnburning and What Can Be Done To Prevent It," 22 Tort and Insurance Law Journal 511 in 1987; "Surety's Liability for Consequential Damages Under Payment and Performance Bonds," Surety Claims Institute in June, 1988; "Fidelity Law Update" in June, 1994; "The Historical Background of Bad Faith Claims and Their Relationship to the Performance and Payment Bond Surety," 28 Tort and Insurance Law Journal 611 in 1993; Chapter 10, "Performance, Payment and Bid Bonds," Missouri Construction Law Missouri Bar in 1994; "Salvage/Subrogation Considerations," Chapter-Bond Defaults ABA in 1995; and Missouri and Kansas Chapter in "Fifty State Construction Lien and Bond Law," 2d Edition in 2000.
Mr. Witten co-edited the American Bar Association Tort and Insurance Practice Section Fidelity Topical Index and Bibliography and the Surety Topical Index and Bibliography.
