    DJ's Tavern owner David Weeks of Yorkville was arrested and taken into custody at his Yorkville home later that day, where police seized $55,000 from his home.At the tavern, police seized $2,000 from the slot machines, in addition to an undisclosed figure.

    Delaney, Weeks, Faber and the bartenders were all taken into custody and charged in the Kane County Circuit Court with one count of Conspiracy to Commit Gambling, a Class 3 felony punishable by a maximum of two to five years in prison.

    This is the conclusion made recently by Dave Weeks, owner of D.J.'s Tavern in Elburn.

    He had hoped to open a second restaurant and bar, Poor Boys, in the commercial building being built on Route 47 just south of McDonald's.However, promises from the developer of a September 1 occupancy never materialized, and even the December 1 deadline stipulated on the lease was not honored, according to Weeks.

    Firmly believing his new business would be well-established by mid-December, Weeks says he had booked two Christmas parties and one New Year's party for Poor Boys.He even began training new employees.

    Instead, the new equipment remains in storage, the new employees have been dismissed and the parties cancelled.

    "I would have never signed (the lease) eight months ago if I thought the building wouldn't be open by December 1," says Weeks.

    With the holiday season gone, and with it the promise of holiday profits, Weeks said he is taking his new business to a different location, possibly outside of Elburn.

    Though Elburn may be minus one Poor Boys, the commercial site at Route 47 doesn't expect to be minus a business.
