    I had great feedback about Nigel's paper on the Hardy's Wine RoT, so who better than Nigel Watson to cover two very significant cases on a similar theme.The first is the High Court decision in General Motors Acceptance Corp Australia v Southbank Traders Pty Ltd.It is now well established that the Corporations Act does not require retention of title clauses to be registered with ASIC.But is that the end of the story?Southbank Traders considered whether a retention of title clause is a "security interest" for the purposes of the Victorian Chattel Securities Act, and if so, the implications that flow from that.I've asked Nigel to draw on the national resources of his firm, and tell you about the comparable provisions of the respective state legislation.I've also asked Nigel to consider the whether it is possible for a security interest to be covered by more than one of the state schemes - and if so, to consider how any deadlock is resolved and relevant initiatives for law reform.The second decision is the New South Wales Court of Appeal decision - Hill & Anor v Reglon Pty Limited, which explores the issues of ‘bailment,' but in the very practical context of competing claims for ownership of hire equipment.
