Peter Ward, Partner, of Galbally & O'Bryan, gave a television interview on National Nine News on the evening of 27 October, 2004 stating that the alleged incident had been investigated some three years earlier and no Police action taken.
This had not been reported in the Herald Sun article.
In the Herald Sun on Saturday 6 November, 2004 Peter Ward again noted that Lionel Rose denied the allegations which had been investigated three years earlier by the Police who had determined it inappropriate to lay criminal charges.

Mr Ward pointed out that our Justice system is premised on the basic proposition that people are innocent until proven guilty.
He stated that the reporting of mere allegations (out of which no Police charge arises) has the potential to cause unwarranted damage to a person's reputation.
