    "The key in this case is that the court said that if a plan fiduciary does not carry out the investor's direction in a reasonable amount of time and that causes the individual investor to lose money, then the fiduciary can be sued," said Kevin Troutman, a labor law attorney in Houston.

    That means that a loss of value because the stock market tanked is not grounds for filing a lawsuit.The loss has to relate to an employer or plan administrator's misconduct.
