Kirby McInereney's lawsuit claims Conaway misrepresented Kmart's financial status and made false and misleading statements to the public in the company's monthly sales and quarterly earnings announcements.That lack of disclosure artificially inflated Kmart's stock prices, the lawsuit claims.Kmart's stock closed at $10.58 a share May 17 and at 85 cents a share Jan. 25.
