    New York State vehicle and traffic laws give officers broad protections in cases of crashes or fatalities, including those involving innocent bystanders, according to Touro Law Center Professor Martin Schwartz, who studies police conduct issues.

    Schwartz said those laws were not intended to be the basis of policy and "police departments can have training and supervision and implement policies that are more cautious."

    Martin A. Schwartz, law professor at the Jacob D. Fuchsberg Law Center of Touro College (N.Y.) and a former legal services lawyer, writing in the New York Law Journal, argues that the logic of the Court's ruling could have implications for the restriction barring legal services lawyers from bringing class actions.He writes, "The restriction constitutes viewpoint discrimination because it instructs legal services attorneys that they can advocate only individual claims, not class claims," even if a lawyer believes that a class action would be "the strongest strategem for her client(s)."He concludes, however, that "given the closeness of the vote in Velazquez and the narrowness of the decision, it seems unlikely that the Supreme Court would hold that if Congress funds a legal services program, it must include class actions within the program."
