UTICA -- A restaurant and a tavern in the city are closing because of lagging business, owner Ernie Sanita said.

Sanita is the owner of Orien Enterprises Inc., which three years ago bought the Columbia Restaurant at 500 Columbia St., he said.

Sanita is also owner of Mandeville Realty Inc., which bought the Bearded Dolphin tavern, at 517 Mandeville St., two years ago.

Both establishments have been struggling to stay open, Sanita said.

"There's not enough jobs around here to sustain (the population)," Sanita said. "Business was declining for failure to create jobs, and the tax rate is going up as far as the business tax rate."

The buildings will be dismantled and sold, he said.

Ernest Sanita, owner of Mandeville Realty Inc., issued a notice of claim dated May 30 naming the city of Utica, the city's Urban Renewal Agency and Codes Department, Codes Commissioner Robert Sullivan, Codes Officer Thomas Carville and Julian.
    ...
In the notice, Sanita claims the respondents "have continuously destroyed the (claimant's) business, income and reputation."

Officials at Utica's Corporation Counsel office said Tuesday they had not yet reviewed the notice and could not comment on it.

A notice of claim signals the possibility of a lawsuit.

In the notice, Sanita cites instances in which he alleges the city interfered with his contracts with other clients concerning city property and conducted site inspections on the claimant's businesses, properties and business interests.

Sanita called these inspections "retaliatory and malicious in nature, unlike the routine treatment accorded to competing business and individuals in the city," according to the notice.

The claimant also alleges that on May 28, he lost a financial deal because of the actions of the city.

Sanita is the owner of Mandeville Realty Inc., which bought the Bearded Dolphin tavern on Mandeville Street two years ago. In February, he announced he was closing the Dolphin and the Columbia Restaurant because of slow business.
