Shell Oil, and its effects on commercial real estate transactions, Sahn and Gershonowitz note that the decision "makes clear that there are a number of significant issues affecting environmental review on which different courts have reach different conclusions.For the practitioner, that means that a close review of the law of the jurisdiction in which the transaction is taking place is necessary to effectively negotiate."
