Chief Deputy Illinois Attorney General Alan Rosen said Wednesday's ruling is of little consequence because the state would not have tried to sell the license before the appeals court renders a decision.

"It's going to take a considerable period of time for the Gaming Board to get in position to auction this license anyway," Rosen said."We think as a practical matter it doesn't mean anything."

He said the appeals court is scheduled to hear oral arguments on Rosemont's appeal in February, and the state is hopeful the court will quickly deny the appeal so it can proceed with auctioning the license.
