The Australian Plaintiff Lawyers Association (APLA) opposes NSW Government plans to make people injured at work to pay for a deficit in the WorkCover scheme by cutting their benefits," Allison Robertson from APLA says.

The changes include introducing a list of approved specialists who will make binding decision on an injured person's medical state.

Other factors causing concern include the likelihood that the specialists will make their decisions behind closed doors; only very brief records of the interviews with victims will be kept, and injured people, whose grasp of English may be limited, will be alone.

"APLA is also campaigning for the decision to introduce private underwriting into the NSW workers compensation scheme to be rescinded," Ms Robertson says.

"Trade unions, employers and lawyers oppose the introduction of private underwriting. The only stakeholder pushing for it is the insurance industry. This is hardly surprising since they are profit driven and there are huge profits to be made from the investment of funds," she adds.

It is estimated that private underwriting will add 25% to 30% to the cost of the scheme, an additional $300 million a year

"WorkCover may have a large shortfall as a result of inefficiency and bureaucracy, but the alleged deficit raises some serious questions," Ms Robertson says.

"How is it that the scheme was reported to have a $1 billion surplus in November 1994 and a $983 million deficit in August 1995?

"How is it that in February 1992 the scheme's reserves were so high that WorkCover increased benefits by 25 per cent across the board with no increase in premiums?

"A considerable amount of money has been flowing into the scheme every year. In 1996/97 NSW companies paid WorkCover $1.5 billion.
    ...
"APLA believes that WorkCover should make the figures public to answer these questions," Allison Robertson says.
