BARTOW - It took Polk Circuit Judge Susan Roberts only 47 seconds Tuesday to sentence convicted mass murderer Nelson Ivan Serrano to death for shooting four people.
    ...
When it came down to the sentencing, Roberts wasted no time. The entire hearing lasted less than 10 minutes.

"The court has decided to impose four sentences of death, one for each of the victims," Roberts said.

Serrano, 68, stood motionless as Roberts read her decision.
    ...
In her order, Roberts said evidence supporting the death penalty, coupled with the jury's recommendation for a death sentence, outweighed the character testimony presented by the defense lawyers.
    ...
The jury agreed with the state, voting 9-3 last October to recommend that Roberts impose the death penalty.

In his defense, Serrano's lawyers maintained that their client had a clean criminal record until this incident and that he was considered older, at 59, when the crimes took place. They also presented more than 20 character witnesses, including family members, who testified that he was a caring, generous family man who often helped his friends when they needed money or time.He also had behaved well while in jail, they said.

In the end, Roberts ruled that it wasn't enough to outweigh the state's arguments and the jury's recommendation for the death penalty.
    ...
Roberts suggested that prosecutors reconsider seeking the death penalty against Ballard, given his age.
    ...
On July 2, Roberts will cycle to the family division during a routine reassignment of judges in the circuit.

Polk County Circuit Judge Susan Roberts heard three motions on the Nelson Serrano murder trial this morning, although she said that she wasn't going to rule on any of them today.
    ...
Therefore Roberts should declare that her court had no jurisdiction over him and should order Serrano be returned to Ecuador.
    ...
Assistant State Attorney John Aguero argued that Roberts had already ruled on those matters during the trial when the defense entered motions to dismiss.
    ...
Aguero said that no new evidence has been introduced to the court, so Roberts should not revisit her previous rulings on the matter.

The public defender's office had backed Roberts, accusing Hill's office of "judge shopping."

The state argues that it would be improper for Roberts to oversee trials that involve the two detectives.

In the order denying the broader disqualification, the appeals court ordered defense lawyers in those seven cases to provide arguments as to why Roberts should not be disqualified.

Those are due Friday, making it unlikely a decision will be released until next week, at the earliest.

The state has accused Roberts of ruling contrary to law because of an inordinate fear of appellate reversal, mistreating the families of crime victims, and a general bias against the death penalty.
