    Richards acknowledged on Monday that Lennard had not followed Mercury's in-house recommendations when it came to sector weightings.The firm's sector strategy group had advised, among other things, that managers be underweight in bank stocks, but Lennard chose to have none.

    However, Richards said these were only recommendations and that Mercury employed intelligent people, allowing them significant freedom with their investments.

    Sumption suggested Lennard was either trying to beat the performance targets or his portfolio was too high-risk for the returns required under Mercury's contract with Unilever.Richards said neither was true.But on Tuesday, the court was provided with a copy of a report written by a member of Mercury's internal audit team.

    Richards told the court on Wednesday that Mercury considered the downside performance threshold governing the fund was no more than a point at which Unilever would become "uncomfortable" and begin asking questions.Mercury was required to avoid underperforming its benchmark by more than 3 percent .

    "The key objective was still to outperform over the longer period," he said.

    Harwood replaced Richards on the stand, telling the court that criticism of Lennard's portfolio was being made with hindsight.
