    My husband called the finance department and spoke to Fred at 11:00 a.m.He told him that we were no longer interested in the jeep.At that point, Fred told him that we had in fact been approved at NCB and that we were now obligated to keep the jeep.I spoke to Fred myself, and asked him to please tell me at what point were we approved, and also the date of denial.He put me on hold for a couple of minutes, and then told me that he could not locate the fax from NCB, indicating approval or denial.He said it was missing from my file.I then asked him for NCB's phone number; he said that he did not have it.

    Also on Sunday, the jeep was still at the Ricart lot.I drove down to remove my personal items from the jeep, and had also written a letter to Nick, in the hope that he would uphold his commitment to us.I was approached by one of the sales managers and was told that I had been approved for the loan, that the jeep was my responsibility, and that I needed to drive it off the lot or it would be towed to my home at my expense.I told him to do whatever he thought he needed to do.I handed Fred the letter I had drafted to Joe, and left the lot.

    Upon returning home, I reviewed my Spot Agreement, which was signed by both myself and Fred (in financing department).This agreement clearly states that Ricart had six days to secure financing, or the vehicle could be returned.I drafted another letter to Nick, and faxed it, along with a copy of the first letter, and a copy of the spot agreement to his office.

    Again, note that we were told of denial at NCB on Wednesday, June 10, 2000; told of approval at Bank One on 6-13-00; and miraculously approval at NCB on 6-14-00, after we told Fred of our intention to rescind the deal.

    The problems I have with these inconsistent stories are such:I was contacted and told that I was denied through NCB on 6-10-00. Spot agreement would have had to be fulfilled by 6-12-00. I was told that I was approved by Bank One on 6-13-00. I was told that I could walk away from the car if I did not want to complete financing with Bank One at the higher rate, also on 6-13-00. I was told of approval through NCB only after I advised Fred that I wanted to rescind the deal.The date was 6-14-00 Upon requesting information from Ricart on the status of the loan application through NCB (i.e. date of approval, date of denial, etc.), Fred said that the paperwork was missing from my file. Upon requesting the phone number and contact name from NCB so that I could get the information from them, I was told (by Fred) that he did not have the number.

    Obviously, things are not as they should be.At a minimum, I would say that this is unethical; at a maximum, I would dare to say that what the financing department is doing is fraudulent (missing paperwork, looking for higher interest rates, etc).I obviously have no way of knowing if they ever processed the NCB loan prior to 6-13-00; my paperwork, which should be retained by Ricart, is missing.

    "Anytime a new product is announced, especially high-dollar products like automobiles, you have to spend money to announce the arrivals," said Fred Ricart, co-owner of Columbus-based Ricart Automotive.

    But car and truck advertising is also driven by competition.Ricart said interest-free financing, first launched by General Motors Corp. to help its Chevrolet division in 2001, fueled local car ad spending last year.

    "A lot of the additional spending (last year) was due to factory incentives, which essentially forces a dealer to advertise more," he said."Competition forces the market."

    Though the dealers track sales weekly and adjust their ad spending, 2003 could become a tricky path.

    "If we go to war, I think everyone is hopeful the market will be less panicked than they were for Desert Storm," Ricart said."Everybody is treading carefully.
