"If the judges were subject to re-election on too-regular of a basis, they might do things in order to get votes," said Peter Rayhill, president of the Oneida County Bar Association.
...
"They might do what's popular rather than what's just," Rayhill said.
...
With longer terms, judges "don't feel that every decision is one that will be held against them in an election," Rayhill said.
...
Rayhill, however, thinks the state's current system of electing judges is working just fine.
"I haven't seen flaws that lead me to believe we need to go to a federal-based" way of selecting judges, Rayhill said. "The question is are you willing to listen and be impartial and use your intellect?"
Besides, Rayhill added, for those judges who may be over-confident in their authority, there are still other ways to prevent judges from flawed decision-making.
"They are all held accountable if they are wrong," Rayhill said. "There are means to remove judges for derogation of duty or violation of office."
Even if a judge isn't moving their caseload efficiently enough, the state's Office of Court Administration can always examine a judge's behavior.
As for elected politicians, Rayhill recalled "courageous" mayors, governors and presidents that lost their re-elections because of decisions they made that were not popular with the public.
"The difference is that you don't want judges recalled or pulled off the bench because they took a stand that was contrary to the majority vote," Rayhill said. -
