    The FEC rejected suggestions from the Alliance and others that only communications that expressly advocated the election or defeat of a candidate could be "coordinated."Instead, the FEC decided that a communication could be "coordinated" if it merely refers to a candidate or party within 120 days of an election. (An earlier version of this provision was not limited by the 120 requirement, but the FEC adopted an Alliance for Justice proposal to create such a time-limited safe-harbor.)

    "Despite the First Amendment and clear Supreme Court precedent, the FEC still believes that it can regulate speech that does not support or oppose candidates," added Pomeranz.

    "The Alliance for Justice supports a ban on soft money but we must oppose Shays-Meehan because it would silence the independent voices of public interest groups through its ban on certain advertising and the potential sweeping restriction on communications with candidates" said John Pomeranz.

    The Alliance also opposes the bill's "electioneering communications" provision, which prohibits unions and corporations (including most nonprofits) from referring to federal candidates in broadcast communications made within 30 days of a primary or 60 days of a general federal election.

    "Public interest groups are the only ones to speak out on many of the tough issues in an era when pollsters have convinced many politicians to avoid taking tough stands," says John Pomeranz, Nonprofit Advocacy Counsel for the Alliance For Justice."Abortion, gun control, the death penalty - these and other issues are too hot for politicians to handle.Silence the independent advocates and you dumb down the political debate."Pomeranz added, "this puts a gag on legitimate issue advocacy by nonprofits."

    The Alliance for Justice also opposes Shays-Meehan's directive to redefine coordinated activities under federal election law.Federal law already forbids corporations, including nonprofits, from making any expenditures that are undertaken at the suggestion of a candidate, party, or campaign.The bill's directive to the Federal Elections Commission to promulgate new regulations brushes aside a federal court opinion and month-old regulations that have not been given a chance to work.

    Worse yet, the regulations sought by Shays-Meehan would make it effectively impossible to engage in lobbying and voter education activities in the same election cycle.Pomeranz stated, "Shays-Meehan's coordination rule is perfect for lazy conspiracy theorists - if a candidate has any meeting& any shared professional staff& any perceived opportunity to coordinate with someone else, the law will assume it happened."
