Adam Poe, with Western Land Group Inc. of Denver, which is representing the developers in the exchange, told commissioners "development would be better centered along an existing developed corridor rather than in the backcountry of the San Juan National Forest."

He said developers were working to address public concerns about having access to the land and having houses ruin the view.

The threat is very real, said Adam Poe, a land exchange expert with Western Land Group.A 1996 land swap involving a 160-acre parcel in Keystone Gulch illustrates how the patenting process can be used to leverage real estate value from patented mining claims, ultimately at great cost to the public.

"It's a really good example of what could happen if the moratorium is lifted," Poe said.

County records don't show what the original cost of that patent was, but Poe estimated that the average cost for patenting mining claims was about $10 per acre.

"The barbed wire went up on both sides of the road," Poe recalled.

Western Land Group's Adam Poe said he has been talking with various entities in the county, but couldn't say for sure if he can round up enough TDRs.

"It depends on what's enough," he said, adding that one potential deal involved about 33 TDRs owned by Denver Water on the Blight Placer, in the Snake River Basin.

Western Land Group's Adam Poe, whose organizaion arranges land trades, says smaller stakeholders can engage in land trades, but typically have to pool their efforts.

"For the smaller guy who doesn't have a portfolio of lands that the U.S. might want, it's tough for them," he says.

Adam Poe of Western Land Group, a company that specializes in such land exchanges, said the Vassar Meadows deal was unusual.

"Everyone shook hands and said, 'let's make it work.' That doesn't happen much these days," he noted.
