    The zone was the third level of tax incentives granted to Rackspace in an incentives agreement that brought the company to the former Windsor Park Mall site, said Jim Plummer of Fulbright & Jaworski.

    Adopted in August, the agreement gives Rackspace a variety of incentives to lease the former mall from Windcrest, including a 14-year tax abatement on the property through the state, and in exchange Rackspace will conduct a multimillion-dollar renovation of the mall site and locate more than 4,000 employees there, among other requirements.

    The council designated the reinvestment zone through the city as a precaution in case other incentives granted by the county and state aren't fulfilled, Plummer said.

    To keep it clearly within the laws governing the venue tax, a performing arts center should be near a convention center, said Jim Plummer of Fulbright & Jaworski, who explained to each committee the parameters of the state law that made the tax possible.

    Other sites probably could be fit into other provisions of the law, Plummer said, but because HemisFair Park would clearly conform, and because Wolff and Mayor Phil Hardberger have given it their blessing, the committee members voted at their first meeting to consider it before they look elsewhere.

    "As these deals go, it's a very good deal," said Jim Plummer, an attorney with Fulbright & Jaworski, who represented the county and helped develop the agreement.

    He said the county fares better in this agreement compared to other counties that signed such plans.By comparison, Edinburg would receive more rent than Nueces County but that town did not receive any money from the team to construct the stadium.
