    For the last few years, Tampa developer Ken Morin had a contract to buy the land from its owners, a south Hillsborough County family.Morin had planned to build a massive open-air shopping center called Southbend Towne Center.However, he had a falling-out with the Sumner-Thompson family ownership group, wound up in litigation against them and gave up on the mall project by last summer.

    Once Morin stepped aside, as many as 20 developers from across the country made offers for the property, said Jo Alice McDonald, whose Plant City real estate firm, McDonald Realty Services, represented the landowners.

    Developer Ken Morin, president of Morin Development Group, has contracts on 10 acres between Cypress and Gray streets, and Oregon and Rome avenues.

    Morin plans to build a potential $100 million project with 60 town houses, 80 to 100 condominiums, 250 apartment units and commercial retail with restaurants, a deli and hair salon.

    "If I were to guess, this would be the largest proposed development in the history of West Tampa," Morin said.

    He has applied for a land-use change with the Hillsborough County City-County Planning Commission.A vote isn't expected until December and, if approved, Morin then must go to the Tampa City Council to request zoning changes.

    The large amount of land that could be compiled in the area enticed Morin.

    Building on small lots wouldn't change the area, but a large project could transform the industrial park that is sandwiched by two neighborhoods, Morin said.It also can encourage other developers who want to build on one and two lots, and it can bring back the neighborhood, Morin said.

    "For whatever reason, this area was overlooked," Morin said.

    The town houses would sell in the low- to mid-$300,000s, Morin said.He didn't have a price for the town houses or rental costs for the apartments.

    The buildings will range from two-story town houses to three- and four-story condominiums and four- and five-story apartment complexes.Except for the town houses, the buildings will vary in elevation.

    To reduce street parking, the project includes a garage on site for residents and customers of the retail shops.

    Morin anticipates young professionals, middle managers and college students taking advantage of the development.

    For five years, Morin has considered proposing a development in the area.In the last year, his staff worked on assembling the property.

    All property that they need for the project is under contract, Morin said.That includes large businesses, such as Graybar Electric, 801 N. Rome Ave., Nations Floral, 1516 Lemon St., and Checker Cab and Yellow Cab, 502 N. Oregon Ave.

    "I believe the neighborhood believes in what we are doing, so we are prepared to close," Morin said.

    A pair of developers from Palm Beach County are suing Tampa developer Ken Morin and MDG Walter LLC, seeking unspecified damages based on money they claim Morin owes them from completion of the 13-acre retail center at Dale Mabry Highway and Interstate 275 in Tampa.

    Leslie Evans and Joseph Boan claim in a complaint filed Sept . 6 in Hillsborough County Circuit Court that they were partners with Morin in the development of Walter's Crossing, with Morin being a 50-percent owner and Evans and Boan owning 25 percent each.

    The plaintiffs claim Morin represented to them that the net cost involved in developing the former Walter Industries Inc. headquarters site would be approximately $23.4 million.Morin told them he arranged for a "guaranteed maximum construction contract" to avoid cost overruns in construction and development, the complaint said.

    Morin also told Evans and Boan in October 2004, while construction at Walter's Crossing was still under way, that he intended to sell the shopping center to Inland Real Estate Acquisitions Inc. for $30.1 million, resulting in an expected gross profit of $6.7 million.

    In January of this year, according to the lawsuit, Morin told his partners that MDG "was experiencing significant cost overruns" and, therefore, no profit would result from the project.

    Boan and Evans said they demanded an explanation, to which they claim Morin "reacted in an extremely belligerent manner, cursing ... and refusing to provide information or a credible explanation."

    Evans and Boan, who are currently pursuing a townhome development project in Lake Worth under the name JLS of Florida City, claim that Morin "has abused his position as managing member of MDG for his own personal gain and to the detriment of MDG and its members."

    They further accuse Morin of making misrepresentations to the plaintiffs regarding the costs and profitability of the Walter's Crossing development, and stated in the lawsuit that he "paid himself excessive compensation and received excessive benefits as the managing member of MDG."The letters stand for Morin Development Group LLC, Morin's company based in Tampa.

    Efforts to reach Morin for comment about the lawsuit were unsuccessful in recent weeks.
