Motion made by Pat Martonis, seconded by John Merchant for a five year renewal of the special use permit for Memory Garden for Nicholas Ferreri, 560 Fairmount Ave., W.E., Jamestown, NY starting in September 2006 with the condition that a report is supplied once a year concurrent with the fire inspection time giving the specifications of how the special use permit is being used and the conditions of the facility to the Zoning Board.

3) there are four wall signs totaling 118.7' - there was discussion on the number of signs - the Board needs to determine if Starbucks, Drive Thru and the Logo were separate signs - Pat said if they are going to consider that as one sign they would have to get rid of the logo - John asked if thy need drive-thru on the sign - Mr. Petru said the drive-thru is a certainly a critical component of their business

John said because they already have the ground sign that says drive-thru he did not feel they needed to have it again on that side of the building.

Motion made by Pat Martonis, seconded by John Merchant to approve the signs for Starbucks Coffee, 944-956 Fairmount Ave., W.E., Jamestown, NY for 65.3 SF over the allowable 100 SF, which includes one sign on Green Street (that says Starbucks Coffee in 16 " letters), a sign on Fairmount Ave. (that says Starbucks Coffee Drive-Thru with a logo in 16" letters), no sign on the Wicks Avenue side and no signage on the north side.
