The Humane Society's Lawyer, Chris McGrath says the whalers are breaking Australian law and the government can stop the Japanese by seizing their ships.
CHRIS MCGRATH: Australia should seize the Japanese ships whaling in Australia's Antarctic waters because they're breaching Australian law which protects whales in those waters, that's the first thing.

CHRIS MCGRATH: I think viewed objectively, the risk that the Antarctic Treaty system would be destroyed or destabilised by Australia enforcing its laws against Japanese whaling in Antarctica, that risk appears small and remote.

But Chris McGrath says the government already has the power to legally stop whaling.
CHRIS MCGRATH: We have sovereignty over a large tract of Antarctica and our domestic laws valid under international law because we have sovereignty in that area.
