WHEREAS, on July 12, 1996, the City Council and Robert T. McDaniel entered into an employment agreement which provides certain conditions applicable to the position of City Manager ; and.

WHEREAS, Section 5 of the Employment Agreement, as amended, provides that the City agrees to increase said base salary and/or other benefits of the City Manager in such amounts and to such an extent as the City Council may determine desirable on the basis of an annual salary review and evaluation of said City Manager, with said review and evaluation to be made between August and December ; and.

WHEREAS, the 1999 City Manager Evaluation Committee has completed the Council-approved process for evaluating the performance of the City Manager with completion by all City Council members of a City Manager Evaluation Questionnaire based on a rating scale defined as follows :.

Unsatisfactory - City Manager consistently fails to fulfill job requirements.

BE IT FURTHER RESOLVED that prior to the payment of severance pay to Robert T. McDaniel, and on or before December 15, 1999, he shall place at the disposal of his successor, or to the City Clerk if no successor shall have been chosen by that date, all City records, assets, and other effects in his custody.

BE IT FURTHER RESOLVED that the Mayor is hereby authorized to accept expressions of interest in serving as Acting City Manager from members of the City's senior staff, and to make recommendations to City Council for appointment of an individual qualified to fill that position prior to December 1, 1999.

The motion was seconded by Mayor Kuhaida.

Deliberation of the substitute resolution was lengthy with participation by all members of City Council as well as the City Manager and the City Attorney.
