Increasingly, Haynes and Boone LLP lawyer Ernest Martin Jr. is reading insurance policies. That's because, he says, during lean economic times, insurance companies tend to deny or defer claims. And companies are more willing to sue, or at least to threaten to sue, to get the coverage they desire.

In the past 18 months, the insurance section of Haynes and Boone has collected $100 million in insurance payments on behalf of corporations that thought their insurance policies should have covered them when they didn't.

"Big firms are accustomed to being sued," Martin said."They're not used to being the plaintiff.I tell them they get to make the demands. It blows their minds."

Martin makes his living off the fuzzy wording in insurance policies and accompanying endorsements -- he reads them like paperback novels. So do the 10 other lawyers in his section. That's because policy holders generally win when a judge determines an insurance company has written ambiguous language into its contracts.

Martin said he'll read a policy five to seven times before he finds the key words that will unlock a concession or judgment on behalf of his corporate clients.

"It's in the fine print," Martin said."I'm helping companies and it's simply holding the insurance company to its promise."

Kerry Brown, whose firm usually fights on behalf of insurance companies, said that companies that hire the likes of Martin can just as well end up with a pile of legal fees, and none the richer.
