    Roughly one-third of the city's property is occupied by tax-exempt schools and churches, according to Carmody & Torrance attorney, Mark Malaspina, who is currently crafting enabling legislation to create a municipal water authority that could transfer proceeds into the city's pension system.

    The plan, which requires approval by the state legislature, is one of three options the city is entertaining, Malaspina said.Other options for addressing the unfunded pension liability are a pay-as-you-go proposal and the issuing of a traditional pension obligation bond.If the plan is not approved before the state General Assembly shuts down in June or July, the cause would be taken up again next year, Malaspina said.

    Among advantages behind the water authority proposal possibly include a higher credit rating than the city's GO rating, which would allow it to borrow at lower interest rates, Malaspina said.Waterbury's previous issues had underlying ratings of BBB by Fitch Ratings, Baa2 from Moody's Investors Service, and BBB from Standard & Poor's.The city's last issue was approximately $ 51.6 million of general obligation tax revenue intercept refunding bonds in September 2004.

    Water customers such as senior citizens, who don't use a lot of water but have moderate to high property taxes, would also benefit under the water authority proposal, Malaspina said.

    Conversely, large water customers who pay low property taxes would pay more under the water authority plan, Malaspina said.
