    PROFESSIONAL BACKGROUND

    From 1999 to 2006, Mr. Levitas served the U. S. Senate Committee on the Judiciary, Subcommittee on Antitrust, Competition Policy & Consumer Rights, where he was Staff Director and Chief Counsel for Antitrust Subcommittee Chairman Mike DeWine (R-Ohio).In this capacity, Mr. Levitas was responsible for developing the Subcommittee's legislative and oversight agendas and directing work for Chairman DeWine on the entire range of issues within the Judiciary Committee's jurisdiction, including homeland security, immigration, antitrust, intellectual property, tort reform, criminal justice, constitutional issues, and judicial nominations.He also developed and managed Subcommittee hearings focused on domestic and international antitrust enforcement, as well as on competition issues in numerous industries, including telecommunications, domestic and international aviation, cable and satellite services, defense, energy, professional and collegiate sports, healthcare, and agriculture.He also worked with the full Judiciary Committee on numerous other antitrust issues, including hearings examining the Microsoft case.Additionally, Mr. Levitas has Top Secret security clearance and worked on intelligence issues for Senator DeWine.

    From 1991 to 1997, Mr. Levitas was a trial attorney for the Antitrust Division of the U.S. Department of Justice.In this position, he investigated and prosecuted criminal and civil violations of federal antitrust statutes.Most notably, he was a member of the trial team for successful criminal prosecutions of price-fixing after a multiyear investigation of the metal container industry in United States v. Lima (D.N.J. 1995), United States v. Milikowsky (D. Conn. 1994), and United States v. Gaev (E.D. Pa. 1993).In addition, he was co-lead counsel on a related perjury case targeting an industry executive, which was settled days before trial in U.S. v. Bey (N.D. Illinois 1998) He also conducted and participated in investigations involving potential violations of the Clayton and Sherman Acts in merger and civil non-merger matters, and reviewed and analyzed Hart-Scott-Rodino pre-merger applications in a range of industries.

    Mr. Levitas was detailed from the Antitrust Division for five months spanning 1994 to 1995, to serve as a Special Assistant U.S. Attorney in the Misdemeanor Section of the U.S. Attorney's office.In this capacity, he prosecuted a handgun possession jury trial and numerous bench and magistrate trials.
