Mr. Keiser pointed out that the online status of availability of NIV appointments is changed frequently and sometimes twice in a day-in the morning and in the afternoon.The changes are based on the demand and supply of different categories of NIVs and the availability of TDPs.
Of the four posts in India, the Mumbai post is the only one that requires the submission of documents to the VFS five working days prior to the visa appointment when booking an online appointment.According to Mr. Keiser, this is because of the space constraints, the lack of street facing offices where documents can be accepted and vetted, and the high volume of applicants at the post.

Mr. Keiser specified that the post continued to deny attorney representation to applicants during the consular interview.This was, among other reasons, because of procedural delays ensuing from attorney interaction during the interview and partly due to the space constraints faced by the post and other posts in India.However, an attorney could submit a letter and additional information, which would enhance the merits of an applicant's H-1B or L visa request.
Mr. Keiser was also of the opinion that an attorney's letter may not carry much weight with regard to an applicant's nonimmigrant intent.But, Mr. Keiser recognized that the US immigration process at the consular level did not support an appeals process.
