On the heels of another lawsuit recently unsealed from federal court, Uintah County is facing a similar suit filed by the county's former road foreman, John Kay.
Kay was appointed executive director of roads and GIS by Uintah County Commissioners, Lloyd Swain, Cloyd Harrison and Dave Haslem on April 1, 2001.

In the suit Kay contends that on Dec. 1, 2001 he discovered serious engineering and surveying defects, errors and other problems related to the Dry Fork project and other county projects.The projects include SR 121 in front of Uintah High School and the Stanton Road Project from Bonanza to the Colorado border.
On Feb. 19, 2002 Kay said he met with Commissioners and the Uintah Country Attorney to advise them of the problems.The suit states that by way of retaliation for Kay having provided the notice, on Feb. 23, 2002 he was given written notice by the Commissioners of their intent to relieve him of his duties as the county director of roads.Illegal actions taken by the commissioners included harrassing him, firing him in favor of other employees who refused to disclose the waste of county funds, hiding his personal day timer, GPS handheld unit, palm pilot and threatening physical injury.
Kay requests that he be reinstated as Uintah County Executive Director of Roads, given payment of his back wages, reinstatement of benefits, paid $50,000 as provided by the Fair Labor Standards Act and reimbursed for his attorney fees.
