    Assistant County Prosecutor Tammie Riley Jones said she decided to dismiss the charges because of an April ruling by the Ohio Supreme Court on indictments that fail to specify the mental state of the defendant, which is one of the elements that must be proven to obtain a conviction.

    Jamen was indicted 11 months before the ruling, and Jones said the indictment didn't include wording as to Jamen's mental state.

    Before the court ruling, Jones said prosecutors could correct such oversight by amending the indictment, but she believes the court ruling prevents her from doing that.

    Assistant County Prosecutor Tammie Riley Jones said they made the plea deal because there was no evidence alcohol played a role in the accident, and Maola's attorneys were prepared to introduce evidence indicating Barnhart had driven left of center.Both of these factors could create reasonable doubt among jurors at trial, which was scheduled to begin yesterday.

    "I think this was a reasonable resolution of this case given the conflicting evidence," she said.
