    AGENT: Greg Johnston, CES
    ...
We have with us an application for so called Robinson Lane Subdivision, represented by Greg Johnston from CES.
    ...
The project as you know is RW2 zoning says Mr. Johnston.
    ...
Yes, a small portion says Mr. Johnston.
    ...
We are continuing the discussion on the Robinson Lane Subdivision application being represented by Greg Johnston from CES.
    ...
Chairman Clunan invites Mr. Johnston to speak now.
    ...
That is correct says Mr. Johnston.
    ...
A small portion of the property is in SR2, says Mr. Johnston.
    ...
Greg Johnston moves the plans closer for the Board members to see. A lot of environmental studies have been done since the last meeting. Studies on the habitat, areas on preservation.
    ...
Mr. Bright asks Mr. Johnston if the site work that they have in their packets is the work from Mr. LaBelle.
    ...
Mr. Johnston says septic system "C" is conveyed to an abutter and is not part of the subdivision.
    ...
Mr. Johnston says that "D" is dedicated to two units.
    ...
"Yes", replies Mr. Johnston, it has the capacity of ten bedrooms.
    ...
First, says Mr. Johnston you are talking about septic system "E"? "Yes", replies Chairman Clunan.
    ...
Mr. Johnston, I think where I am getting confused is the last time we met you gave us a sketch plan in which you had house locations, says Chairman Clunan.
    ...
I think that I will go back to your question says Mr. Johnston.
    ...
    Yes, says Mr. Johnston.
    ...
While we are talking about the lots, says Mr. Johnston, can we talk about some of the things we have looked at and where we have been since last time.
    ...
Mr. Johnston asks are you talking about the shoulder or the wall side here? Can you explain the right triangle? It's a 60 degree triangle that you have drawn and you have a dimension that is a 45 degree triangle. That is for somewhat of a scale purpose just to draw your attention to the slope says Mr. Johnston.
    ...
Yes I do says Mr. Johnston and in response to that I think we can get to something but in this size, we couldn't necessarily do a one to one we wouldn't be able to get it on a piece of paper.
    ...
Greg Johnston says no, there is a note on the plans that say outside of this cutting will be prohibited.
    ...
Yes, says Mr. Johnston that is further down.
    ...
    Exactly says Mr. Johnston.
    ...
That is correct says Mr. Johnston.
    ...
    Potentially says Mr. Johnston.
    ...
I don't understand how individual (?) I think the first question is that they are on individual septic systems says Mr. Johnston.
    ...
If there is something else that you are requesting, says Mr. Johnston lets look at it.
    ...
    Yes says Mr. Johnston.
    ...
We have thought about that says Mr. Johnston.
    ...
Mr. Johnston will speak with the applicant.
    ...
No, replies Mr. Johnston. We could have either or says Mr. Johnston. But we could ask you to do filter fabric. I am just thinking down the road when they rot. I agree says Mr. Johnston.
    ...
Yes, replies Mr. Johnston. It is built into the slope, and the surface water drains into it.
    ...
Nothing slows down the water when it gets there says Mr. Johnston.
    ...
Some of this water will come down in a flash flood, not being able to sink in and does go across the road, says Mr. Johnston.
    ...
That's where it goes now, replies Mr. Johnston those culverts are there.
    ...
Interesting question says Mr. Johnston all around anywhere when you build.
    ...
This is like a twenty-five year storm replies Mr. Johnston.
    ...
Not necessarily says Mr. Johnston. Those culverts right now that exist, exist in ? 300 feet. There really are four locations for the water to disperse. I see what you are saying says Mr. Johnston.
    ...
    Yes, says Mr. Johnston.
    ...
I believe it could be improved, replies Mr. Johnston.
    ...
There will be a adequate turn around space for emergency vehicles, says Mr. Johnston.
    ...
Yes, it needs some improvement says Mr. Johnston.
    ...
I believe with the Boards approval, it can be at a greater slope replies Mr. Johnston. Back up says Mr. Tracy I would like you to address my question of the road being grossly in violation of what our State requirement is as far as the steepness goes. It is not says Mr. Johnston.
    ...
If I am reading this correctly says Mr. Johnston that is what I believe it to say.
    ...
We believe Robinson Lane is a private road says Mr. Johnston.
    ...
Mr. Johnston says we are going over the plans with you and your power to do.
    ...
Three or more lots and units say Mr. Johnston.
    ...
No, Mr. Johnston says we are asking you to approve the partial with nine units.
    ...
Mr. Johnston says that they are not ready to reschedule at this time.

Mr. Johnston for CES says that it is a sandy area and with the storms and wave action at the bottom of the area, it is eroding.
    ...
Mr. Johnston replies the bottom portion of the retaining slope will be larger boulders, two to three foot in diameter. Keyed in below ground, two courses below grade fall landward of the high water line.
    ...
Mr. Johnston says that the work is planned for late fall.  With some frost in the ground, they will be able to use trucks on the lawn.
    ...
Mr. Johnston says that the others had more clay soils, which made it more difficult. Mrs. Reilly wants to know how they are going to establish vegetation. This bank will tie in to the existing slope with smaller rip rap. No chain link fence to hold it up? No, replied Mr. Johnston. Mr. Miller wants to know what is growing there, now. On the banks themselves, some alders, some spruces, and Rosa Rogosa not a lot.  Mr. Johnston says, when you look at the bank, you will see large boulders.

6.1     Expert Testimony:  The Planning Board or code enforcing officer(s) in deciding whether or not to issue a permit shall be governed by the standards set forth in this section.  The Planning Board or code enforcing officer(s) may reasonably require an applicant for a permit to furnish at the applicant's expense expert testimony, including documentary material, to prove compliance with such standards. The Board finds the expert testimony heard from Greg Johnston of CES, Inc. who has designed the bank stabilization plan to be sufficient.

Mr. Greg Johnston, P.E., CES, Inc. was present and explained part of the purpose tonight is to discuss the access to the lots. Schoolhouse Ledge Road is considered a 20 foot wide right of way; also there is a 20 foot wide right of way (ROW) access to the property. He asked the Board if there have been situations and/or applications in the past that may allow additional housing with a limited ROW access. He has had preliminary discussions with the Fire Chief regarding similar situations in Town. From the pre-application information provided, maps and plans were consulted. Manchester Road was corrected to Millbrook Road.
    ...
Mr. Johnston said they will do more research.

Mr. Johnston, representative from CES, Inc., reported that the final plat is not ready because in accordance with the LUZO Section 3.6 Note (d), Kimball Farm LLC as owners of all adjacent lots, would like to enter into agreement to reduce the building setback distances from 15 feet to 10 feet for structures on Lots 1 through 6 in locations as highlighted on the plan presented with the request, and that would become the Final Plat Plan if the request is approved.

Mr. Shaw's engineer, Greg Johnston, has stated previously that engineering techniques can be used to overcome poor soils on the site.At the March 19 public hearing on the project, he said that all homeowners will be required to install pretreatment systems for their household waste, which will greatly reduce the amount of nitrates entering the ground. He also said that all of the stormwater flowing off the property will be filtered.

A peer review of Mr. Johnston's plans, completed by Ransom Engineering of Portland, concluded that with those safeguards in place, the subdivision could be developed as proposed without causing undue groundwater pollution.
