Franklyn began suffering baldness from mold toxicity just before entering the sixth grade at IS 391, near his home in Crown Heights.

Regulations allow head coverings for medical reasons, and Franklyn's doctor wrote to officials in September 2002 suggesting the boy be allowed to wear one to keep him from being teased about being bald, according to the suit.

Despite the note, the lawsuit says, Franklyn was harassed in by school personnel, including a substitute teacher who told him, "Take that do-rag off your head, you look like a drug dealer"; a teacher's assistant who pulled it off Franklyn's head, and a teacher who looked directly at Franklyn and told him to "take garlic for your cancer."

School workers also expressed fear that other kids were going to get infected by Franklyn, according to the suit.
