CBG's attorney, Frank Hoegen of Wilkes-Barre, said an agreement has been signed with a lending source, which he referred to as a "financing group," in London.

"We're working out the details of that right now," he said. "Then, we hope to be in the position to file a plan of reorganization in the next three to four weeks."

Hoegen said a few conditions remain to be resolved, but expects everything to be finalized early next week.

In fact, he is hoping that a signed agreement can be presented to the court at Thursday's hearing, "with an understanding of the bank having a foundation laid for a plan of reorganizatino."

Hoegen, CBG's attorney, said Cedrone only has laid the foundation for a property owners' group, because nothing official can be done until a reorganization plan is approved by the bankruptcy court.

Hoegen said he could not comment on the lawsuit because the papers have not yet been served. That must be done within 90 days of its filing, according to federal law.

Attorney Frank Hoegen, who is co-counsel for CBG with his father, Peter, said outside court that the new funding source "is a better deal for everybody. He would not identify the company, but said it is based in the United States.

Other than the changes outlined in court, CBG's reorganization plan would remain intact, Hoegen said.

Cedrone and his attorney, Frank Hoegen, of Hoegen and Marsh in Wilkes-Barre, say they had not received a copy of the lawsuit.

"They can't sue CBG because it is protected by federal bankruptcy laws," Hoegen said.

Friday, Frank Hoegen, Cedrone's lawyer, said a letter of financial commitment still has not been signed and he could not release the name or names of potential investors.

Hoegen is forthright about the development's financial woes.

As beautiful as the Valley of Lakes scenery is and as much potential profit as a resort promises, the development is not an attractive investment, Hoegen said.

Because of the size of the debt and the size of the property, only a few developers are in a position to invest in the resort. Hoegen said he's been talking to anyone who says they have the capital to invest in such a large undertaking.

"It hasn't been easy, and we've talked to every kook out there," Hoegen said.
