Wesley Higbie practices Business and Commercial Law, Natural Resources Law, and Government Contracts Law, dividing his time between civil litigation (primarily in federal courts), and business counseling and transactions.
Mr. Higbie earned his BS in Forestry from the University of California, Berkeley, and his JD at the University of San Francisco School of Law.He was formerly General Counsel to the Western Timber Association and has extensive experience in forestry matters.
Mr. Higbie is a member of the State Bar of California, and the bars of U.S. District Courts for both the Eastern District and Northern District of California, the U.S. Court of Federal Claims, U.S. Court of Appeals for both the Ninth Circuit and the Federal Circuit, and the U.S. Supreme Court.He has litigated matters in all of these courts and has argued appeals in the California and federal courts of appeal, as well as the California Supreme Court.In addition, he has represented clients in numerous cases before federal agencies and the Boards of Contract Appeals.Representative reported cases include: Sierra Pacific Ind. v. Lyng, 866 F.2d 1099 (9th Cir. 1989); Arcata Forest Products Co. v. U.S., 18 Cl.Ct 93 (1989), aff'd.915 F.2d 1584 (Fed. Cir. 1990); Seaboard Lumber Co. v. U.S., 903 F.2d 1560 (Fed Cir. 1990); Stone Forest Ind. v. U.S., 973 F.2d 1584 (Fed. Cir. 1992), Eel River Sawmills v. U.S., 27 Fed.Cl.604 (1993); R.C.O. Reforesting v. Mr. Higbie has considerable practical experience in the organization and operation of businesses, having advised businesses throughout his career.In addition, he is businessman himself, being a founder of Sierra Cedar Products, a lumber manufacturer in Yuba County, California, as well as a principal in HFTA, a company working with the University of California to commercialize technology for extracting sugar from wood waste.
He has represented clients in a variety of commercial and real estate transactions, including the purchase and sale of timber, timberland, industrial and residential property, secured lending, and commercial sales of goods.
He is rated "AV" (highest possible ability and ethics) by the Martindale-Hubbell attorney rating service, and is listed in the Martindale-Hubbell Bar Register of Preeminent Lawyers under natural resources law and business law.
He is a member of the American Bar Association, a Fellow of the ABA Section on Energy and Environment Law, and was Chair of the ABA Forest Resources Committee, 1982-85.He was President of the California Alumni Foresters, 1995-96, and occasionally lectures at the UC, Berkeley, College of Natural Resources.He is a member of the Advisory Boards of the United States Court of Federal Claims and the University of California Forest Products Laboratory.
