    The law suit is against the Texas Commission on Environmental Quality (not Rushing).It will be filed by Renea Hicks, attorney at law, of Austin, Texas contesting the constitutionality of the issuance of the permit for the construction of an asphalt plant by Rushing Paving Company LTD, CN600466601 authorized on March 11, 2007.
