On behalf of over 150 Concerned Citizens of Grayson County and others, their attorney Renea Hicks, filed a motion today with the Texas Commission on Environmental Quality (TCEQ) asking the Commissioners to overturn or otherwise reconsider issuance of the authorization for the Rushing Paving Company Ltd. to operate a hot mix asphalt batch plant near Denison's edge at the gateway to the quaint lake resort community of Pottsboro near Lake Texoma.

The group ‘Concerned Citizens of Grayson County,' and their attorney, Renea Hicks, filed a motion with the TCEQ asking to overturn or reconsider the issuance of the permit.

Since that permit was approved, Rushing Paving has started construction on the asphalt plant next to their offices on FM 120.

On behalf of over 150 members of Concerned Citizens of Grayson County, the City of Pottsboro (population 1,600) and 24 named plaintiffs, a lawsuit was filed by attorney Renea Hicks against the Texas Commission on Environmental Quality (TCEQ).

The coalition of Concerned Citizens of Grayson County , has retained Renea Hicks to file a law suit contesting the constitutionality of the permit allowing installation of a hot mix asphalt batch plant on F.M. 120 at Preston Road near the schools and communities of Pottsboro and Dension.If you would like to become a party to this suit, please respond by e-mail as soon as possible . The law suit is against the Texas Commission on Environmental Quality (not Rushing).It will be filed by Renea Hicks, attorney at law, of Austin, Texas contesting the constitutionality of the issuance of the permit for the construction of an asphalt plant by Rushing Paving Company LTD, CN600466601 authorized on March 11, 2007.
