The witness was a man named William Heimanson.Heimanson is a photographer for the City of Los Angeles, assigned to the Scientific Division of the LAPD, which includes the photo lab.Heimanson has held that position since being hired in February 1990.On or about June 16, 1996—about two weeks before this trial began—Heimanson had a casual conversation with another photographer, Jim McCrary.

In the course of their conversation, Heimanson brought up the Enyart trial.He told McCrary that he knew Jim was going to testify for Enyart.Then, Heimanson turned to McCrary and said in effect, "You're going to win."
