Another key piece of evidence was a videotaped deposition of Robert Heimann, former chief executive of American Tobacco Co., which made Lucky Strike cigarettes and was bought by Brown & Williamson last year.In the deposition, Mr. Heimann questioned the validity of all research concluding that smoking causes disease, including reports made by the U.S. surgeon general, the American Medical Association, the American Cancer Society and the American Lung Society.

Asked if the surgeon general was more qualified than he to conclude that smoking is dangerous to health, Mr. Heimann replied: "Frankly, no."
