The Internal Revenue Code used to contain two exclusions from income for death benefits. One was the employer-provided death benefit, which had a maximum exclusion of $5,000.The other was for proceeds of life insurance contracts payable by reason of death. In 1996, the tax law was amended to repeal the $5,000 employer-provided death benefit.Union-provided death benefits never were included in this exclusion because they were not employer-provided.Typically, these benefits are paid out of the general assets of the union or out of a separate fund maintained for this purpose.
