Paul E. Gutermann heads Akin Gump's energy, land use and environment practice and has practiced environmental law in Washington, D.C., for over 25 years.Mr. Gutermann has a national practice litigating cutting-edge issues arising under all the major statutes and negotiating environmental issues in corporate mergers, divestitures and restructurings.He also works closely with Akin Gump's public law and policy practice, assisting clients before Congress and executive branch agencies on policy development.
Mr. Gutermann has served as lead trial counsel defending major enforcement actions brought by the United States, in states from New York to California and national citizen groups.He has tried cases involving alleged violations of New Source Review and New Source Performance Standards requirements, compliance with federal and state regulations governing the management of hazardous waste, and cost recovery under CERCLA and state analogs.Mr. Gutermann defended the first "multimedia" enforcement action brought by the U.S. Environmental Protection Agency, alleging violations under federal and state law related to waste, air and water issues.Among his other experience, he defended one of the first private-party cost recovery actions under CERCLA and challenged the application of a state hazardous waste rule on the basis of the invalidation of the federal rule.
Mr. Gutermann has represented clients in connection with the development of federal legislation on such issues as the acid rain requirements and efforts to regulate carbon emissions under the Clean Air Act, the total maximum daily load requirements under the Clean Water Act, and data compensation under the Federal Insecticide Fungicide and Rodenticide Act.He has also worked with clients on the development of agency regulations ranging from the definition of solid waste and the recycling of hazardous waste, to the Tier 2 fuel standards and implementation of the Montréal Protocol.
Mr. Gutermann has been the lead environmental lawyer on transactions representing companies acquiring and divesting assets; the value of transactions on which he has worked total in the billions of dollars.He has represented creditors' committees in connection with the restructuring of Solutia, Inc., Kaiser Aluminum and LTV Steel.
Mr. Gutermann's regulatory counseling experience includes negotiating NPDES permits with EPA and state agencies, retrofitting surface impoundments to meet minimum technology requirements, compliance with land disposal restrictions, negotiation of corrective action orders with EPA regional offices and Part B permitting issues with state regulatory agencies, and Title V air permits.
Mr. Gutermann received his A.B. cum laude and with high honors in 1978 from Clark University, where he was elected to Phi Beta Kappa and was captain of the varsity baseball team.He received his J.D. in 1981 from Case Western Reserve University, where he served as editor in chief of the Case Western Reserve Law Review and was a member of Order of the Coif.He is a member of the District of Columbia Bar and is admitted to practice before the U.S. Supreme Court, several U.S. courts of appeals, and the U.S. District Courts for the Districts of Columbia and Maryland.He is listed in peer-review publications, including The Best Lawyers in America and Who's Legal USA: Environment.
