    DAVID S. GORDON, ESQ.

    David Gordon is a Shareholder in Wilentz, Goldman & Spitzer, P.A., in the firm's Woodbridge, New Jersey, office.He is a member of the Commercial Real Estate Team, the Land Use/Environment Team and the Redevelopment Strategic Business Unit.His practice focuses in the representation of developers, owners, users and other clients in all aspects of real estate transactions, with an emphasis in land acquisition and disposition, development approvals, financing (including construction, interim and permanent mortgage financing as well as equity participation), leasing (representing landlords and tenants in commercial, industrial and retail transactions), construction contracts and the structuring of business entities.

    Mr. Gordon is a member of the American College of Real Estate Lawyers (ACREL), where he serves on the Board of Governors and has been a three-term chair of the Membership Development Committee.He is also a past two-term chair and current member of the Leasing Committee and a member of the Insurance Committee.

    Mr. Gordon is also a member of the Faculty and Advisory Board of Georgetown University Law Center's Advanced Commercial Leasing Institute and a former Adjunct Professor at Rutgers Law School where he taught Advanced Real Estate Transactions.He has lectured for several groups and has been a co-author and contributing editor of several texts, including ICLE's Commercial Real Estate Transactions in New Jersey and State-by-State Guide to Commercial Real Estate Leases (Aspen Publishers).

    A graduate of Bucknell University, Mr. Gordon received his J.D. from Columbia University School of Law where he was a Harlan Fiske Stone Scholar and a member of the editorial board of the Journal of Law and Social Problems.

    I. CONSTRUCTION BONDS -- THE OVERVIEW

    Every construction project is fraught with uncertainties and threatened by so many tangible and intangible perils that it sometimes seems surprising that anything ever gets built.Although the risks clearly increase with the scope and complexity of the project , from the simple home renovation to the publicly financed sports and multi-purpose entertainment venue ( i.e. , indoor arena ) , many of these uncertainties are common.Carefully drafted contracts and careful selection of contractors can reduce the risks , but contractors , owners/developers ( owner ) and lenders alike frequently turn to independent third parties to help reduce the risks inherent both with selection of the contractors and with the contractors' ability to complete with skillful and lien-free performance.

    David S. Gordon joined the firm in 1999 after spending 17 years with a major New Jersey real estate/litigation firm.He subsequently served as Senior Vice President and General Counsel for two regional real estate development companies and established his own New Jersey-based real estate law firm.Mr. Gordon's practice centers on representation of developers , owners and other clients in all aspects of real estate transactions with an emphasis on land acquisition and disposition , financing development of real estate ( including construction , interim and permanent mortgage financing as well as equity participation ) , leasing ( representing landlords and tenants in commercial , industrial and retail transactions ) , negotiation of construction contracts and the structuring of business entities.

    Mr. Gordon was elected to membership in the American College of Real Estate Lawyers in 1989 and is a member of ACREL's Insurance Committee and vice chair of the Leasing Committee.He is also a member of the Real Property , Probate and Trust Law section of the American Bar Association.He served as an Adjunct Professor at Rutgers University School of Law , Newark campus , teaching a course in advanced real estate transactions , and is co-author of New Jersey Real Estate Forms-Practice , published by Lexus Law Publishing.He has lectured for a variety of groups including the New Jersey Institute for Continuing Legal Education , the New Jersey chapter of the National Association of Industrial and Office Properties ( NAIOP ) , the New Jersey Mortgage Bankers Association , the American Banking Institute , the New Jersey Title Institute and Lorman Business Services.On several occasions Mr. Gordon has served as an expert witness on legislative matters for NAIOP.He has also served as chairman of NAIOP's Housing Linkage Fee Committee and its Construction Lien Law Committee , and he was extensively involved in the drafting of New Jersey's Construction Lien Law.

    Mr. Gordon received his B.A. from Bucknell University in 1967 and his J.D. from Columbia University School of Law in 1971.While at Columbia he was a Harlan Fiske Stone Scholar and on the editorial board of the Journal of Law and Social Problems.He is admitted to practice in the State of New Jersey , and before the United States District Court for the District of New Jersey and the United States Third Circuit Court of Appeals.

    Mr. Gordon resides in East Brunswick , New Jersey , with his wife , Andrea.They have three grown sons.

    "This has been a transforming event in the museum's life," said museum director David Gordon, who leaves next year to become a consultant after more than five years at the museum's helm.

    Gordon, a former business journalist who came to Milwaukee from London's Royal Academy of the Arts, started in 2002, when the museum was looking for a way out of debt and to raise its profile.He wanted to create a feeling of vitality at the museum, even with the "mountain of debt."So he appointed a new chief financial officer and put the museum's financial statements and annual reports online.

    He also eliminated the fee for people to look around the museum's addition, put major exhibitions in one room, added more lectures in collaboration with local arts organizations and allowed other nonprofits to hold fundraisers, something banned previously.

    Some of the more popular exhibitions the museum has attracted include "Biedermeier: The Invention of Simplicity," "Degas Sculptures" and "Leonardo da Vinci and the Splendor of Poland."

    Gordon said he looks for riskier exhibitions, even if they don't pull in large numbers, to expose the public to different art.An example was "The Quilts of Gee's Bend," which he and his quilter wife loved when they saw it at the Whitney Museum of American Art in New York.

    "It's made an impact on the African American community," Gordon said."Whenever I meet people from the community, they refer back to the exhibition and can't wait until we do something similar again."

    He said the Francis Bacon exhibit, which ended earlier this year, was risky, too, because the Irish-born British expressionist painter was not well-known in Milwaukee.Fewer people turned out than expected, but that didn't bother Gordon.

    "We've got to do things which are artistically valid and worthwhile," he said.
