On behalf of the local board, Chairman Paul Gallagher testified that the local board was concerned with the sight lines from behind the bar to the patio.

Chairman Gallagher testified that there are residents approximately 1,000 feet away.Chairman Gallagher also testified there have been prior complaints about noise and other incidents in the parking lot of the establishment.Chairman Gallagher further testified that the prior licensee had a reputation for running a bad operation and that the neighbors are afraid.Chairman Gallagher described the decision not to allow the alteration of premises as a quality of life issue.The Commission reviewed Exhibit #2, which was an aerial view of the establishment.Other than a new gas station, it was agreed this photo accurately represents the location site.Chairman Gallagher admitted that the proposed patio is hedged between tall trees and a 30-foot building wall.

Chairman Gallagher testified and conceded that he never received a complaint from anyone regarding the establishment.Gallagher stated that in fact, he eats at the Royal Garden with his family and it's a pleasant experience.
