    Paul T. Gallagher

    Paul Gallagher joined Cohen Milstein in 1996. He is a Partner in the Firm; the head of the International Practice Group; and a member of the Antitrust practice group. He is also the Liaison Partner for the Firm's London office.

    In the antitrust area, Paul has been involved in the successful prosecution of price-fixing litigation against manufacturers of explosives, which resulted in a $70 million settlement; a case against manufacturers of high fructose corn syrup for alleged price-fixing, which resulted in a settlement of over $500 million; abuse of monopoly claims against U.S. Tobacco Company, which resulted in a settlement of over $20 million; and price-fixing claims against Mercedes-Benz and a number of its regional dealers.

    Currently, he is acting on behalf of victims of the international cartels involving alleged fixing of surcharges relating to Air Cargo and Air Passenger transportation by the major international airlines. He is also co-lead counsel in a massive RICO class action against the major cigarette companies regarding their fraudulent marketing of "light" cigarettes as less harmful, a case in which damages to the class are estimated to be in the billions of dollars.

    Over his career, Paul has developed an expertise in issues involving International antitrust litigation. He played a major part in the international Auction Houses price-fixing litigation, which settled for $40 million. This suit was the first time that a class comprised solely of non-U.S. citizens obtained compensation under the U.S. antitrust laws. He also argued and obtained a favorable D.C. Circuit Court of Appeals decision in the international In re Vitamins Antitrust Litigation, which has had a significant impact on antitrust jurisprudence and was characterized by one academician as "one of the most expansive antitrust decisions of the last 30 years." That decision ultimately came before the United States Supreme Court.

    In the human rights area, Paul played a prominent role in the historic litigation against major Swiss banks for withholding assets deposited by persecutees fleeing the Nazis prior to and during World War II. This litigation settled for $1.25 billion. He also played an active role in the litigation and resolution of claims against the German government and industry for, among other claims, the use of persecuted persons to perform slave labor during the War. That case resulted in a settlement of over $5.2 billion. Paul was honored by the Government of Poland for his contributions to this effort.

    As head of the Firm's International Practice Group, he oversees all of the Firm's international activities as the Firm continues to establish itself as the leading international claimants' practice. He has had the honor of representing claimants, both in U.S. courts and elsewhere, from around the world, including England, Ireland, France, India, Poland, Sweden, Ukraine, Belarus, the Czech Republic, Panama, Ecuador and many other countries.

    He is frequently asked to speak at international conferences on matters relating to international litigation; the most recent example of which was his presentation in London on "Class Actions, The Coming Threat." He has been featured and quoted in many articles including the Wall Street Journal, the New York Times, the Washington Post, Forbes and the ABA Law Journal and most recently was named by LawDragon magazine in it's "New Stars; New Worlds" 2006 edition.

    Paul received his B.A. in Government and Politics (1986) from George Mason University and graduated from the Marshall-Wythe School of Law of the College of William & Mary in 1992. He was a member of the William & Mary Law Review, as well as the Law Review of the University of Cincinnati School of Law, where he attended his first year of law school and was ranked first in his class.

    The price-fixing lawsuit will allege that the five leading U.S. tobacco companies raised prices they charged to cigarette distributors within hours and sometimes minutes of each other , said Paul Gallagher , the attorney. Class-action suits on behalf of smokers who may have overpaid for cigarettes also are likely to be filed within the week , Gallagher said. It alleges they have increased prices in lock step , Gallagher said of the suit , to be filed today in a Washington federal court. Plans for the lawsuit were reported today in the Wall Street Journal and the Washington Post. At times , wholesalers and distributors got notification of identical price increases within hours or even moments of each manufacturer , Gallagher said. That indicates that these were not independent pricing decisions made by the companies , he said. Philip Morris , R.J. Reynolds Tobacco Holdings Inc. , British American Tobacco Plc's Brown & Williamson Tobacco Corp. unit , Loews Corp.'s Lorillard Inc. , and Liggett Group , a unit of Brooke Group Ltd. , will be named as defendants , Gallagher said.

The suit initially will be filed on behalf of wholesalers-based in Buffalo , New York , and Bryan , Texas , said Gallagher , a Washington lawyer at the Cohen , Milstein , Hausfeld & Toll firm , which is leading more than 20 firms in the case. The suit , in which lawyers plan to seek class-action status , seeks unspecified damages that Gallagher said could reach hundreds of millions or billions of dollars. The allegations are based on documents and evidence that have been amassed in litigation against the tobacco industry. The tobacco industry had previously reached a $246 billion settlement with U.S. states over allegations that tobacco companies concealed the health hazards of smoking. The industry is also fending off attempts by the U.S. Food and Drug Administration to regulate cigarettes as a drug. The U.S. Supreme Court is considering whether to give the FDA such authority.

Philip Morris Cos. , the No. 1 tobacco company , initiated the increases and others followed , a strategy that some analysts said plays out in almost every industry.
