    Mark Fredkin, representing Mr. Pakravan, subject property owner, explained that his client had been subject to a two year review process and had modified his development plans many times to appease and mitigate the concerns of the neighbors.

    Mark Fredkin, attorney representing the Loma Serena Homeowners Association (applicants) explained that the subject easement had been outstanding for 36 years because of the potential that a school would be built and access needed.He stated that since a school was never built, there is no longer a public purpose for the easement.Mr. Fredkin pointed out that if the City were to abandon the easement, the land would revert back to open space, which would preserve the City ambience and rural character as prescribed in the General Plan.He explained that for these same reasons abandoning the easement would be for a public benefit.Mr. Fredkin argued that to maintain the unused easement for the purpose of providing an access option for a potential development would equate to maintaining the easement for a private benefit – the construction of a private development.Mr. Fredkin referred to a letter dated 1991 sent by former City Manager Rosemary Pierce stating that the maximum number of houses that the City would allow on the land that the subject easement leads to, would be 4.The letter further stated that any use of Via Palomino as access would need to be approved by both the City and the Loma Serena Homeowners Association.Mr. Fredkin stated that abandoning the easement would be consistent with the General Plan and would be for a public purpose in that it would promote open space and maintain the general character of the City.He urged the Council to take action on the matter this evening, since so many people are affected by the matter, and that with the impending development of the nearby property the Council's action would provide clearer direction.Mr. Fredkin discussed the possible findings the Council could make to abandon the easement and urged the Council to take action.
