    John Flynn, a private lawyer who acts as a Natick town counsel, said he recommended that the selectmen include the provision in the contract.He persuaded another community in suburban Boston to insert such a clause in contracts with town administrators in the past, he said.He declined to identify the community.

    Flynn disagreed that the provision in Natick runs afoul of the Americans With Disabilities Act.He noted that the clause authorizes the Board of Selectmen to suspend or fire the town administrator only if he is unable to carry out his duties after receiving treatment and "reasonable accommodation."

    "That's why I don't believe it violates any of the applicable law with respect to handicaps and disabilities," he said.

    "It's rare from my experience, because there aren't too many midshipmen that go to court-martial," said former Navy lawyer John Flynn, now in private practice in Buffalo, N.Y.He represented midshipmen through the academy's Office of Legal Counsel from June 1999 to June 2001.

    During his time, Flynn said, cases that started with criminal charges usually finished at the administrative conduct level, without a court-martial taking place.Midshipmen can be separated through the conduct system, an internal disciplinary process.
